The evolution of product compliance frameworks continues to reshape global markets, particularly in high-risk sectors such as energy storage. The latest India BIS battery regulations introduce stricter requirements for verifying the rated capacity of portable sealed secondary lithium cells and batteries, reinforcing transparency and consumer protection.
India BIS Battery Regulations and Capacity Verification
On February 10, 2026, the Bureau of Indian Standards (BIS) issued new guidelines mandating the measurement and verification of battery capacity in accordance with IS 16047 (Part 3):2018/IEC 61960-3:2017. The regulation specifically requires testing discharge performance at 20°C, ensuring that declared capacity reflects actual product performance.
From a legal engineering perspective, this requirement reduces the risk of misdeclaration and establishes a more reliable conformity assessment system. It also aligns India’s framework with internationally recognized technical standards, improving regulatory interoperability.

Implementation for Existing Licensees
The updated regulation introduces clear compliance timelines for current BIS license holders:
Licenses valid until April 30, 2027 must comply by that date
Licenses extending beyond this deadline must comply by their expiration
Manufacturers must submit third-party laboratory test reports for all lead models and adopt a revised Unified Test Report Format that includes measured capacity. Additionally, they are required to provide formal undertakings confirming compliance for remaining models within their scope.
Failure to meet these requirements may result in enforcement actions, including license suspension, cancellation, or scope reduction.
Requirements for New Applicants and Scope Changes
For new applicants, transitional provisions allow ongoing applications to proceed without the additional test, provided there is a commitment to submit the required report before license expiration.
However, from May 1, 2027 onward:
No new licenses will be granted under IS 16046 (Part 2) without rated capacity verification
The same requirement applies to scope modifications of existing licenses
This ensures that all future certifications are fully aligned with the updated testing framework.
Regulatory Impact and Legal Engineering Perspective
The India BIS battery regulations reflect a broader trend toward stricter technical enforcement in product compliance. By integrating precise testing methodologies into regulatory requirements, BIS is enhancing both accountability and market transparency.
For manufacturers, this means adapting compliance systems, strengthening documentation processes, and ensuring alignment with evolving regulatory expectations. For the market, it improves product reliability and consumer trust.
Conclusion
The updated BIS guidelines mark a significant advancement in India’s product regulation landscape. Through stricter verification of battery capacity and clearly defined compliance pathways, these measures reinforce the importance of legal engineering in designing effective and enforceable regulatory systems.
