Ukraine: NCEC Adds Wi-Fi 7 (IEEE 802.11be) to Generalized Radio Equipment Use Conditions


Ukraine's telecom regulator has taken a concrete step toward normalizing Wi-Fi 7 devices on the domestic market. On 6 May 2026, the National Commission for the State Regulation of Electronic Communications, Radio Frequency Spectrum and the Provision of Postal Services the NCEC (Ukrainian: НКЕК) adopted Decision No. 212, which amends Decision No. 81 of 12 February 2025, "On approval of generalized conditions for the use of radio equipment or radiating devices." The amended text incorporates references to IEEE 802.11be, the standard commercially branded as Wi-Fi 7.

The practical effect is a market-access simplification, not a spectrum reallocation. That distinction matters, and it is where most secondary coverage of this update goes wrong.


What Ukraine Wi-Fi 7 Approval Actually Covers


Under Article 65 of the Law of Ukraine "On Electronic Communications," the NCEC maintains a catalogue of generalized conditions of use (узагальнені умови застосування) standardized profiles describing the purpose, technical characteristics and operating conditions of radio equipment types by radio technology.


The mechanism works like this: if a new type of radio equipment matches a published generalized condition, the economic operator manufacturer, authorized representative or supplier may rely on that generalized condition directly, without applying to the NCEC for a separate applicability decision for that device type. The operator simply cites the relevant generalized condition and the number and date of the decision that approved it.


Before Decision No. 212, the generalized conditions catalogue referenced IEEE 802.11 legacy variants and 802.11ax, but not 802.11be. Wi-Fi 7 devices therefore sat in an awkward gap: the underlying bands were permitted, but the standard itself was not named in the catalogue, creating friction and case-by-case exposure at the equipment-authorization stage.

Decision No. 212 closes that gap by writing 802.11be into the catalogue.


What Decision No. 212 does not do


This is the critical framing point for regulatory affairs teams:


  • It does not allocate or open new spectrum. Spectrum allocation in Ukraine is set by the National Table of Frequency Allocations (Spectrum Plan), approved by Cabinet of Ministers Resolution No. 1340 of 13 December 2023 and amended by Cabinet resolutions not by NCEC decisions.

  • It does not open the upper 6 GHz band (6425–7125 MHz). That band is where Wi-Fi 7's headline 320 MHz channels live. In Ukraine, the sub-band 6425–7000 MHz is earmarked for IMT (4G/5G) from 1 January 2028, and no RLAN allocation exists for it.

  • It does not exempt equipment from conformity assessment. The Radio Equipment Technical Regulation (Cabinet Resolution No. 355 of 24 May 2017) applies in full.

In short: Wi-Fi 7 is now recognized in Ukraine but only in the bands Ukraine has already opened.

Ukraine's RLAN spectrum position has moved substantially over the past year, and Decision No. 212 should be read against that backdrop.

Two supporting Cabinet measures are worth tracking alongside the NCEC decision:


  • CMU Resolution No. 976 (13 August 2025) amended the Spectrum Plan to open 5945–6425 MHz for broadband radio access the change that made Wi-Fi 6E, and by extension 6 GHz-capable Wi-Fi 7, legally operable in Ukraine. It also removed the "exclusivity" of certain 5 GHz bands for Broadband Radio Access from 1 January 2026, and reserved 6425–7000 MHz for IMT from 1 January 2028.

  • CMU Resolution No. 262 (25 February 2026, effective 4 March 2026) corrected technical errors in Section 2 of the Spectrum Plan: it replaced ETSI EN 302 687 with ETSI EN 303 687 as the applicable harmonized standard for 5945–6425 MHz, and added ETSI EN 300 440 for 5725–5850 MHz. The EN 303 687 substitution is not cosmetic. It is the standard your test reports must cite for 6 GHz RLAN.

What This Means for Manufacturers


If you already ship Wi-Fi 7 devices into the EU, you are close but not identical.


1. Your EU 6 GHz configuration is not automatically your Ukraine configuration. The EU permits LPI and VLP RLAN across 5945–6425 MHz, and discussions on the upper 6 GHz band continue at CEPT/EC level. Ukraine has aligned on the lower 6 GHz band only. A device SKU built for a market with upper-6 GHz access must have that capability disabled for Ukraine.


2. The relief you gain is administrative, and it is real. Previously, a Wi-Fi 7 device type that did not map to a named generalized condition could require an individual NCEC decision confirming applicability a per type submission with EMC technical expertise review. Decision No. 212 removes that step for conforming device types. For a portfolio of routers, APs, laptops, phones and mesh nodes, that is a meaningful reduction in submission volume and lead time.


3. The upper 6 GHz question is now a product roadmap risk, not a compliance risk. Ukraine has reserved 6425–7000 MHz for IMT from 2028. Unless that position changes, Wi-Fi 7's 320 MHz channels will remain unattainable in Ukraine, and 6 GHz operation will be capped at the 480 MHz of lower-6 GHz spectrum. Marketing claims about maximum Wi-Fi 7 throughput should be reviewed against what the device can legally achieve in-country.


4. Confirm your harmonized standard references. If your 6 GHz test reports or DoC cite ETSI EN 302 687, they are citing a standard that Ukraine explicitly replaced in February 2026. Update to EN 303 687.


5. Watch the LPI/VLP boundary. Lower 6 GHz operation is conditional: LPI at ≤200 mW EIRP is indoor-only; VLP at ≤25 mW EIRP may operate indoors and outdoors. Outdoor capable Wi-Fi 7 access points cannot use 6 GHz in Ukraine at LPI power. This is a feature gated permission, not a blanket one.
